Terms of Service – VOXUM
1) General
These Terms of Service (the 'Terms') apply to any use of the VOXUM website and services available at https://voxum.maj.digital (the 'Service'), provided by MAJ Holding Sàrl (CHE-391.786.123), Ch. Bois-Gentil 7, 1203 Geneva ('we', 'us' or 'VOXUM').
Any use of the Service by a user ('you' or 'User') constitutes acceptance of these Terms. If you use the Service on behalf of a legal entity, you confirm you are authorized to bind it and you accept these Terms on its behalf.
We may modify these Terms at any time; you will be informed appropriately. Any subsequent use constitutes acceptance of the updated Terms.
Some services (payments, API, integrations) may be subject to specific terms in addition to these Terms.
2) Personal use conditions
By using the Service, you confirm you are at least 18 years old and, where applicable, authorized to act for the legal entity on whose behalf you use the Service.
3) Access conditions, Internet
Equipment and telecommunication fees required to access the Service are at your expense.
Internet use involves risks (interception, loss, viruses). You accept these risks; we disclaim any resulting liability to the extent permitted by law.
4) Main features and Services
VOXUM enables professional users to analyze their brand visibility across AI models and third-party search engines (OpenAI, Anthropic/Claude, Perplexity, Google, etc.) and obtain aggregated reports.
Some services are paid according to the displayed plans. Orders and payments are handled via our payment provider; additional commercial terms are set out in the applicable documents (e.g., billing).
Prices are shown in EUR/CHF depending on context; they may change. Taxes and additional fees may apply depending on the country.
5) Intellectual property
Subject to user content (sec. 5.3) and third-party elements (models, APIs), VOXUM and its licensors own all intellectual property rights to the Service and its content.
License: a personal, revocable, non-exclusive and non-transferable license is granted to you to use the Service strictly under these Terms.
User content: you retain your rights over content you submit. You grant us a worldwide, non-exclusive, free and transferable license to host, process, display and reproduce such content to operate the Service. We may remove any unlawful content or content contrary to the Terms.
6) Usage restrictions
Prohibited notably: (i) massive extraction or reuse of content (scraping/crawling), (ii) attempting to access source code, (iii) using the Service for unlawful activities, (iv) circumventing our usage limits, (v) using the Service to train models or evaluate individuals, unless agreed in writing.
7) Data protection
Our Privacy Policy forms an integral part of these Terms and describes personal data processing: /privacy.
8) Changes & suspension
We may modify, suspend or stop all or part of the Service, with or without notice, without liability, within legal limits.
9) Warranty disclaimer
The Service is provided 'as is' and 'as available'. No warranty of accuracy, availability or fitness for a particular purpose is given. AI model outputs may contain errors; you remain responsible for their use.
10) Liability
To the extent permitted by law, we disclaim liability for indirect or consequential damages (loss of profit, data, opportunity). Total liability, if any, is capped at amounts paid for the Service over the last 12 months.
11) Indemnification
You will indemnify VOXUM against any claim arising from your breach of the Terms, law, or third-party rights.
12) Miscellaneous
Severability: invalidity of a clause does not affect the rest. Assignment: you may not assign your rights without our consent; we may assign the Service. Force majeure: we are not liable for force majeure events.
13) Governing law and venue
Swiss law applies; exclusive venue in Geneva, subject to mandatory venue.
